The Canton of Bern has for the time being taken out of service the automated vehicle investigation.
The court removes three provisions with new surveillance means from the Bernese law. However, it does not answer the most controversial question. Therefore, everything remains the same with regard to riding school.
The Federal Court cancels several articles in the Bernese police law. Now the canton has to look at the books.
In 2024, the Federal Court prohibited the canton of Lucerne from allowing systems for automatic vehicle investigation by police law. The court sees differently the case of the canton of Bern. A complaint against its police law is only partly good for the court.
On Wednesday, the Federal Court censored several provisions of the new Bern Police Act concerning the automated search of vehicles and the police 'bodycams'. On the other hand, the Canton may impose video surveillance on municipalities in places deemed sensitive, such as the Reitschule of Bern.
