Outdoor Dining in NYC Is Back to Year-Round, After Mayor Zohran Mamdani Signs New Law
The new rules aim to revive a pandemic-era program and ease costs for restaurants that struggled to store and rebuild outdoor setups each winter.
- On Monday, Mayor Zohran Mamdani signed legislation making outdoor dining on New York City roadways a permanent, year-round option for restaurants. The bill allows businesses to use weatherproofing and winterizing materials to operate through winter.
- Adams-Era regulations of outdoor dining nearly broke this program, Councilmember Lincoln Restler from Brooklyn said Monday. Previous seasonal requirements forced restaurants to dismantle setups from November through March, creating unnecessary costs.
- At its peak, 12,500 restaurants offered outdoor dining, but that number dropped to about 1,600 under 2023 rules. A recent analysis by Open Plans found 94% of curbside setups are concentrated in Manhattan and Brooklyn.
- The administration is pursuing a charter amendment to cut the roughly eight-month outdoor dining permit application process to two months. Restaurants can now keep structures up year-round using weatherproofing materials.
- Maulin Mehta, New York director of the Regional Plan Association, believes the new rules will encourage greater uptake. Mehta noted the changes could lead to outdoor dining in more diverse areas throughout the city.
