FDA Seeks Public Feedback to Inform Regulatory Approach for Generative AI-Enabled Medical Devices
The agency is asking manufacturers, clinicians and the public to comment on risk assessment, premarket review and postmarket monitoring for GenAI devices.
On Tuesday, the FDA published a discussion paper seeking public input on regulating generative AI-enabled medical devices, with feedback accepted under docket FDA-2026-N-7874 until October 19, 2026.
Unlike traditional software, generative AI creates variable outputs and potential "hallucinations" that are harder to regulate, prompting the Center for Devices and Radiological Health to develop a new framework.
The agency proposed a "competency-based approach" to premarket evaluation, inspired by how human clinicians are credentialed, involving benchmarking and clinical confirmation of device performance.
To balance innovation and safety, the FDA is considering accepting "greater premarket uncertainty" while increasing reliance on postmarket monitoring to track device performance in the real world.
Acting FDA Commissioner Kyle Diamantas stated the announcement reflects a commitment to leveraging AI to improve patient health outcomes, aligning with Trump Administration priorities to accelerate innovative medical products.
