Despite a "fault" on the part of the State, the court overturned on appeal a decision at first instance which ordered it to compensate the insurer as a result of the destruction of businesses during the uprising of 2024.
The Nouméa Administrative Court had condemned the State in December 2025, as it considered its "responsibility" for the damage caused by the May 2024 riots for failing to establish a "reasonable level of security". The court was seized of fourteen applications filed by Allianz IARD, insurer of several businesses in the Kenu In commercial area, in the Grand Nouméa, burned and looted between 15 and 17 May 2024.
At the beginning of July, the Paris Administrative Court of Appeal quashed a sentence by the State to pay more than 28 million euros to the Allianz insurer for damage caused during the riots of 2024 in New Caledonia.
