Burglar who headbutted pensioner protecting his wife to death jailed
On Thursday, Judge Simon Mayo sentenced Ashley Malcolm to 18 years in prison with a five-year extended license for the manslaughter of 86-year-old John Burke during a burglary in Hackney, London, on September 29, 2025.
During the prolonged burglary, Malcolm attacked Burke at the home he shared with his 91-year-old wife, Peggy, headbutting him and causing a fractured nose and fatal intracranial bleeding.
Within hours of the attack, Malcolm targeted a residential care home and attempted a burglary in Stamford Hill. Over 20 years, he accumulated 12 prior burglary convictions and 10 assaults, including biting a prison officer.
At the Old Bailey, Judge Mayo noted Malcolm's 'extensive' history was a 'substantial aggravating factor.' Defense barrister Emin Kandola presented a statement in which Malcolm wrote, 'I'm very sorry about what happened.'
Sean Burke, who found his father collapsed, described him as a 'quiet, hard-working' man. Judge Mayo acknowledged the 'immeasurable' loss felt by the family after the prolonged trauma.
