SCC Commissioner, Former NextEra Attorney Declines to Recuse Herself From Merger Case
Bagot said independent counsel found no reason for her to step aside, as a ratepayer petition seeks to block her participation in the merger review.
On Monday, Virginia State Corporation Commission Chair Kelsey Bagot confirmed she will not recuse herself from the $67 billion merger between Dominion Energy and NextEra Energy despite her prior employment as a senior attorney for NextEra.
Legislators and ratepayers raised concerns regarding Bagot's impartiality due to her tenure as a senior attorney for NextEra from September 2022 to April 2024, prompting Senate Majority Leader Scott Surovell to request clarification on her participation.
Although Bagot recused herself in April from NextEra's MidAtlantic Resiliency Link project, she stated independent counsel advised that "mere work history with a regulated entity has not served as a categorical basis requiring recusal."
Senator Russet Perry remains critical, citing promises Bagot made during confirmation, while a Dominion Energy ratepayer filed a formal petition on July 24 requesting her disqualification from the proceeding.
Governor Abigail Spanberger expressed skepticism regarding the merger's benefits for Virginia but stated she is relying on the commission's professionalism as public testimony begins November 5.
