Vermont labor board orders state to end return-to-office requirement for employees
The board said the state refused to bargain in good faith and ordered back pay, rehiring offers and other remedies for affected workers.
On Wednesday, the Vermont Labor Relations Board ordered Governor Phil Scott's administration to rescind the "Hybrid Work Standard," ruling the state failed to bargain in good faith with the Vermont State Employees Association over the three-day-per-week return-to-office mandate.
Citing a failure to bargain in good faith, the board found the administration unilaterally implemented the policy affecting more than 3,000 of roughly 8,000 state employees who previously worked remotely three or more days per week.
Beyond rescinding the mandate, the state must reinstate employees who left due to the policy and "make all affected employees whole" by reimbursing any monetary losses caused by the unilateral change.
Governor Scott rejected the ruling as "disappointing, but not surprising," calling the board "broken" and "biased" while filing an appeal with the Vermont Supreme Court on Wednesday.
The Vermont State Employees Association called the decision a "stunning victory," emphasizing the order protects members' rights to negotiate their conditions of employment, contrasting the outcome with executive actions in Washington.
