US appeals court blocks Minnesota’s AI ‘nudification’ law for now in XAI lawsuit
The court said xAI can keep challenging the statute, which Minnesota says was enacted to curb AI-generated child sexual abuse material.
On Friday, the St. Louis-based 8th US Circuit Court of Appeals granted an injunction halting Minnesota's ban on AI-generated fake nude images, pausing the measure while xAI pursues a lawsuit alleging it violates the US Constitution.
Minnesota adopted the "nudification" law this year to combat the spread of child sexual abuse material generated by AI products, while xAI alleges the restriction infringes upon free speech protections.
US District Judge Donovan Frank rejected the company's initial request for an injunction last month, ruling xAI failed to show irreparable harm; the firm disputed this finding in its appeal.
Grok Imagine includes "rigorous protections" against creating sexualized images of real people, according to the company, which has begun suing users who allegedly evade these technological blockers.
The injunction keeps the state law on hold for now as the legal challenge continues; Minnesota had urged the appeals court not to block the measure, and both parties did not immediately respond to requests for comment.
A U.S. court of appeal has suspended a law in Minnesota against AI-generated nude images for the time being. Musk's AI company xAI, however, had sued with reference to freedom of expression.
