US Supreme Court Won’t Hear Challenge to Chicago Lawsuit Against Gun Shop
Chicago says Westforth sold more than 850 guns later recovered at crime scenes, and the case will continue after the justices declined review.
On Monday, the Supreme Court declined to hear an appeal from Westforth Sports, allowing Chicago's lawsuit against the Northwest Indiana gun shop to proceed in trial court.
Chicago sued the gun retailer in 2021, alleging the store sold firearms to "straw purchasers," which the city claims contributed to criminal activity in Illinois.
Between 2009 and 2016, more than 850 guns from Westforth were recovered at crime scenes in Chicago; the city alleged the store sold more than 300 additional firearms to straw buyers from 2014 to 2021.
An Illinois Appeals Court previously ruled that Westforth "deliberately and purposely availed itself of the Illinois market," rejecting the shop's argument that jurisdiction does not lie against out-of-state sellers.
Although the shop has reportedly been closed since 2023, The City remains eager to proceed, stating it is "pleased that the Supreme Court denied plaintiff's request for review.
