The STF decided that protective measures of the Maria da Penha Law apply to gender-based violence in cases of harassment and persecution, even without a domestic or affective bond.
The ruling states that judges are obliged to use the law to combat any type of gender-based violence against women; the regulation was only applied in situations of domestic violence, violence between family members or violence within partner relationships prior to this court decision.
The Court held unanimously that it is possible to apply protective measures irrespective of their occurrence in the family environment
