Republican committees ask US Supreme Court to preserve access to cheaper ad rates
The committees say the ruling would cut voter reach and affect how tens of millions of dollars are spent in midterm elections.
On Monday, The National Republican Congressional Committee and The National Republican Senatorial Committee asked the Supreme Court to block an appeals court ruling limiting discounted advertising rates to candidates only.
Last week, the Fourth Circuit ruled that election ad discounts are only for candidates, rejecting a March Federal Communications Commission public notice that allowed party committees to qualify for the same rates.
Republicans argue the Fourth Circuit decision violates the First Amendment by inhibiting political-party coordination, claiming the ruling "risks smothering political speech severely" and "favors some modes of candidate speech while disfavoring others."
The groups urged the Supreme Court to act before Friday, contending interpretive rules "do not have the force and effect of law" and therefore do not qualify for judicial review.
This quick-turn appeal arrives at the 6-3 conservative Supreme Court, which recently struck down other campaign spending restrictions; if allowed to remain, the ruling will impact tens of millions of dollars in this year's midterm elections.
