Remarks on Himanta Sarma's wife: SC grants anticipatory bail to Pawan Khera in alleged defamation case
On Friday, the Supreme Court granted Senior Congress leader Pawan Khera interim bail in a Guwahati case, overturning the Gauhati High Court's earlier denial of anticipatory bail relief.
An FIR filed by Riniki Bhuyan Sarma, wife of Assam Chief Minister Himanta Biswa Sarma, triggered the case after Khera accused her of holding multiple passports.
During Thursday's hearing, Khera told the bench he shouldn't be "humiliated" with a "custodial arrest," while the Supreme Court criticized both him and the Chief Minister for politically motivated rhetoric.
The court emphasized that "a careful balance must be struck" between the State's interest in investigation and the individual's "fundamental right to personal liberty under Article 21 of the Constitution of India."
Noting that "allegations and counter-allegations, prima facie, appear to be politically motivated," the bench ordered Khera to cooperate with investigation and barred him from leaving the country without permission.
