Post Office Will Fight First Ever Capture Case at the Court of Appeal

The Post Office will oppose the first criminal appeal related to the faulty Capture software despite government findings linking it to wrongful prosecutions of at least 29 sub-postmasters.

  • On 30 January, the Post Office will serve a Respondent's Notice opposing the first Capture case referred to the Court of Appeal, having been invited to respond to the CCRC's application.
  • Capture, rolled out from 1992, was used in up to 2,500 Post Office branches and led to prosecutions of at least 29 former sub-postmasters, while Ms Owen's case was referred to the Court of Appeal last year by the CCRC.
  • Now aged 77, Mr Montagu says the expert report from 1998, calling Capture `quite capable of producing absurd gibberish`, remains available for testimony at the Court of Appeal.
  • Victims receiving £10,000 interim payouts must overturn convictions at the Court of Appeal before compensation, following the 2024 government investigation.
  • A Post Office spokesperson said the organisation wants unsafe convictions overturned and will assist the Court, shortly before the family of Mrs Owen were told her case would be opposed.
