NHS trust 'violated dignity' of nurses by allowing trans woman to use female changing room, tribunal rules
The tribunal found the NHS Trust created a hostile environment by allowing a trans woman to use female changing rooms without alternatives, breaching workplace dignity and discrimination laws.
- Judgment delivered on Friday found County Durham and Darlington NHS Foundation Trust subjected eight nurses from Darlington Memorial Hospital to harassment related to sex and gender reassignment.
- The eight nurses said they brought claims of indirect discrimination, harassment and victimisation after complaints raised in July 2023 were said to have been 'buried', led by Bethany Hutchison and supported by the Christian Legal Centre against County Durham and Darlington NHS Foundation Trust.
- The nurses said Rose Henderson allegedly stared at colleagues, asked why one was not changing, and walked around in boxer shorts, while Mrs Hutchison said, `No woman should be told to 'broaden their mind' or compromise when raising legitimate concerns for her safety and privacy'.
- In response, the trust said it is reviewing the judgment and the EHRC said it will consider the decision, with NHS bodies awaiting EHRC guidance.
- While not binding, the ruling is expected to increase pressure on the NHS and Government to adopt Britain-wide employer guidance on single-sex spaces following the Supreme Court ruling on the definition of 'woman' and Sandie Peggie's partial victory.
