Minnesota families grieve, seek charges after Kansas crash killed 3
Prosecutors declined charges in the fatal crash, citing insufficient evidence to prove criminal culpability and potential jury sympathy, despite the pickup traveling 74 mph.
The Morris County Attorney's Office declined to file charges against a 53-year-old White City, Kansas, driver involved in the fatal May 25, 2024, crash near Council Grove that killed three people.
Troy Sabean and Emma Porter, both 33, and Ann Porter, 69, died when the driver's Ram 1500 pickup, traveling 74 mph in a 55 mph zone, struck their Toyota RAV4 SUV head-on on a gravel road.
Data recorders showed the driver's steering varied over 67 degrees during the final five seconds, and his traction-control system activated multiple times, though the Morris County Attorney's Office noted the victims' vehicle was also near the center line.
County Attorney Brown informed families in March 2025 that the office questioned whether there was "sufficient evidence to secure a conviction" in the case.
With the statute of limitations for filing criminal charges extending five years, survivors and families remain deeply upset, leaving the case potentially unresolved for years.
