US Appeals Court Voids Biden-Era Efficiency Rule for Stoves, Ovens

- On Tuesday, the 5th U.S. Circuit Court of Appeals struck down a Biden administration-era rule setting efficiency standards for gas and electric stoves in a 3-0 decision. The court concluded the Energy Department improperly bypassed required public comment procedures for the "direct final rule."
- Circuit Judge Andrew Oldham, writing for the court, noted that "direct final rules" are reserved for uncontroversial matters. He argued the Energy Department used this mechanism to avoid public scrutiny on a contentious policy facing opposition from several states.
- Seven Republican-led states—Louisiana, Mississippi, Montana, Nebraska, Tennessee, Texas, and Utah—challenged the rule. The court ruled the department failed to consider whether increased appliance complexity would reduce reliability or raise costs, calling the DFR mechanism "untenable."
- Following Tuesday's decision, an Energy Department spokesperson said the Trump administration remains "committed to ensuring that consumers can choose the home appliances that work best for their lives and budgets." This signals a departure from the previous administration's conservation mandates.
- Energy Secretary Chris Wright pledged last month to permanently restrict efficiency mandates for home appliances that "raise costs and disrupt consumer choice." This ruling aligns with President Donald Trump's broader push to reverse energy conservation rules established under President Joe Biden.
