Man shot by Border Patrol in Portland now faces federal assault indictment

Luis David Nino-Moncada, 33, was indicted on charges of aggravated assault on a federal officer and damaging federal property over $1,000.
Federal prosecutors allege Nino-Moncada rammed his truck into an unoccupied federal rental car multiple times after being ordered to exit during an immigration stop.
A Border Patrol officer shot Nino-Moncada and his passenger Zambrano-Contreras, who are both accused of illegal U.S. entry and gang ties.
