French Court Annuls Cash Bid by Late Sultan's Heirs in Malaysia Land Dispute
The Paris Court of Appeal found no valid arbitration agreement and ordered the Sulu claimants to pay legal costs after annulling the $14.9 billion award against Malaysia.
- On Dec 10, the Paris Court of Appeal annulled the about $15 billion award sought by the so-called heirs of the defunct Sulu sultanate, confirming the arbitrator lacked jurisdiction and marking a major milestone for Malaysia.
- Gonzalo Stampa had earlier issued a partial award on May 25, 2020, declared jurisdiction, then a final award on February 28, 2022 ordering $14.9 billion payment despite a Spanish court revoking him.
- The claimants based their case on an 1878 deal that they described as a lease of Sabah, and the court ordered them to pay 200,000 in costs to Malaysia.
- The government added that the Sulu Special Secretariat War Room said the ruling should end claims from the so-called Sulu claimants and accused Therium of seeking to extort money while standing ready to fight further in court.
- Earlier rulings show that on June 6, 2023 the Paris Court of Appeal refused to recognise the partial award, two French courts rejected jurisdiction, and the French Supreme Court dismissed the challenge on November 6, 2024.
