Kilmar Ábrego Garcia Is Set to Be Back in Court as He Battles Deportation to Liberia
The government wants to end a court order blocking deportation to Liberia, while his lawyers seek a permanent ban after a mistaken removal to El Salvador.
On Tuesday, federal officials return to court seeking to lift an injunction that prevents U.S. Immigration and Customs Enforcement from deporting Kilmar Abrego Garcia to Liberia.
Garcia was mistakenly deported to El Salvador in 2025, where he was held in a CECOT mega-prison before the Trump administration returned him to face human smuggling charges in Tennessee that a judge later dismissed.
His legal team is seeking to make the preliminary injunction permanent, contending that any deportation should be to Costa Rica, which previously agreed to receive him.
Former acting ICE director Todd Lyons argued in a March 2026 memo that sending Garcia to Costa Rica would be "prejudicial to the United States" because the U.S. expended resources negotiating with Liberia.
Jossie Flor Sapunar, national communications director for We Are CASA, stated the government "continues to punish him for pursuing his constitutional rights," as the family seeks privacy in Maryland.
