Jack Smith defends decision to charge Trump at Senate hearing
Smith said his team gathered proof beyond a reasonable doubt and that he would prosecute Trump again on the same facts, despite Republican criticism.
On Tuesday, Special Counsel Jack Smith told lawmakers he "will not be silenced by continued threats of prosecution" from the Trump administration, asserting his investigations were conducted without political bias.
Republicans have criticized Smith for secretly obtaining phone records during his investigation of Trump, characterizing the prosecutions as a political "fishing expedition" and an overreach by the Justice Department.
Rep Jim Jordan of Ohio alleged Smith misled Congress regarding phone subpoenas, citing records showing prosecutors obtained contents of 44 lawmakers' text messages; Smith defended the subpoenas as "common practice."
Sen Dick Durbin of Illinois, a top Democrat, accused Republicans of spreading "baseless conspiracy theories" to "whitewash" the Jan. 6, 2021, attack on the Capitol, dismissing attacks on Smith as a "smoke screen."
Although Smith previously brought felony indictments against Trump, he abandoned the cases after the 2024 election citing Justice Department policy; Smith remains a target of retribution, facing ongoing investigations from The Office.
