Hungary loses court fight over frozen Russian asset profits for Ukraine

The court said the case was outside EU judicial review, leaving a 11.1 billion euro aid channel for Ukraine intact, officials said.

  • On Sept. 9, the Luxembourg-based Court dismissed a legal challenge filed by former Hungarian Prime Minister Viktor Orban, which sought to prevent interest from frozen Russian assets from funding military aid to Ukraine.
  • Orban challenged the legality of the European Peace Facility in August 2025, an instrument that has provided Kyiv with 11.1 billion euros in support since Moscow launched its full-scale invasion.
  • The Luxembourg-based Court stated, "Agreements concluded by EU member states under the EU's Common Foreign and Security Policy generally do not fall within the court's remit."
  • Peter Magyar, Hungary's current prime minister since May, has not addressed the case but has affirmed Kyiv's right to defend itself while ruling out direct military assistance.
  • Kaja Kallas, the EU's top diplomat, said on Sept. 1 that agreement was close. "I think it's very clear that there is a determination to unlock the European Peace Facility, and that's something that we will work on very closely," Kallas said.
