Florida Couple in IVF Biological Baby Mix-up Hopes to Find Girl’s Parents, Their Own Child
The couple seeks emergency court orders for record preservation, patient notification, and genetic testing after a fertilization error led to a nonbiological child, according to their attorneys.
- On Jan. 22, Steven Mills and Tiffany Score sued IVF Life Inc. and Dr. Milton McNichol alleging an embryo mix-up after their daughter born Dec. 11 was not genetically theirs.
- The couple says about five years ago, they hired IVF Life, and in 2020, one of three embryos was implanted into Score on April 7, according to the lawsuit.
- Seeking emergency relief, the family asked Circuit Court to compel IVF Life Inc. / Fertility Center of Orlando to preserve records, notify patients, begin genetic testing and submit plans by Friday.
- The family says they love the child and want to continue raising her while fearing legal claims under Florida law on parentage, and Fertility Center of Orlando says it is actively cooperating with an investigation.
- Genetic tests may take four to six weeks, and Orlando attorney Francis Pierce III said attorneys are working toward a quick settlement while seeking a five-year testing window.
