- On Friday, the Environmental Protection Agency and Army Corps of Engineers announced a supplemental notice seeking public input on new definitions for "relatively permanent," "continuous surface," and "perennial" waters within the WOTUS rule.
- This action follows the Supreme Court's 2023 Sackett v. EPA decision, which limited federal authority by rejecting the "significant nexus" test that had governed water regulations for more than 50 years.
- EPA Administrator Lee Zeldin stated the goal is a "durable WOTUS definition" to end "bureaucratic red tape" while ensuring the agency considers all options rather than regulating in a "black box."
- Criticizing the proposal, Center for Biological Diversity policy specialist J.W. Glass warned the rule could "wipe out life-sustaining waterways" in every corner of the nation, leaving wetlands vulnerable to destructive storm surges.
- Agencies will accept public comments for 30 days once the supplemental proposal is published in the Federal Register, building on over 220,000 comments already received from stakeholders during previous public meetings.
