DOJ promises 'a lot more action' on gun rights with new Second Amendment enforcement section
The DOJ's new section will investigate and litigate against state and local gun restrictions, including permit delays affecting over 8,000 applicants in Los Angeles County.
- On December 8, 2025, the Justice Department announced the Second Amendment Rights Section inside its Civil Rights Division, with Harmeet Dhillon saying the unit will protect and advance citizens' right to bear arms.
- Last month, reporting showed AmmoLand's John Crump disclosed plans for the Second Amendment Rights Section opening in early December as a federal response to post-Bruen litigation.
- The DOJ said the Second Amendment Rights Section will use investigations, lawsuits, amicus briefs, and statements of interest to challenge concealed‑carry costs, delays, and firearm bans, Dhillon said.
- Already in action, the DOJ has sued Los Angeles County Sheriff's Department over permitting delays and supported gun owners and federal firearms licensees in Illinois and Hawaii, possibly challenging local laws nationwide.
- At the same time, appeals courts have split as the DOJ defends the National Firearms Act, with Judge Thomas M. Hardiman warning that limiting protections to 'law‑abiding, responsible citizens' risks excluding people from 'the people' protected by the Second Amendment.
