- Atiku and the ADC allege that the All Progressives Congress submitted a forged National Youth Service Corps discharge certificate to the Independent National Electoral Commission, seeking to disqualify President Tinubu from the 2027 race.
- Seeking to refine their case, the plaintiffs asked to replace Form CF001 with Form EC9A and add detailed particulars of alleged fraud to their affidavit, including a written deposition from Atiku.
- President Tinubu's legal team, led by Chief Wole Olanipekun, alongside the APC and INEC, opposed the motion, arguing the proposed changes are "misconceived" and effectively alter the plaintiffs' entire case.
- Defence counsel argued the suit is statute-barred, claiming the cause of action arose on July 11, and that the amendment seeks to cure a jurisdictional defect after expiration of the 14-day period prescribed by the Constitution.
