Judge postpones Yemen’s TPS expiration as Supreme Court decision looms
The ruling pauses the removal of temporary legal protections for about 2,800 Yemeni nationals while appeals continue.
On Friday, U.S. District Judge Dale Ho blocked President Donald Trump's administration from ending Temporary Protected Status for nearly 3,000 Yemeni nationals, preventing the Department of Homeland Security from stripping protections effective Monday.
The administration sought to terminate TPS designations for 13 countries as part of Trump's immigration agenda, but Judge Ho ruled that former Homeland Security Secretary Kristi Noem failed to consult required agencies before ending Yemen's protections.
About 2,810 Yemeni nationals hold TPS, with another 425 pending applications. Citing "the exigencies of the moment," Ho wrote that "Congress has, by statute, established a process for such review," which the Secretary failed to follow.
A DHS spokesperson stated that allowing the nationals to remain was not in the national interest, claiming "temporary means temporary" and criticizing "activist judges legislating from the bench."
The ruling follows the Supreme Court taking up appeals regarding similar humanitarian protections for more than 350,000 people from Haiti and 6,100 from Syria, as the administration faces repeated legal challenges to terminating TPS programs.
