Complaint seeks answers on Scouting America’s transgender policy after Pentagon deal
Dale says the Pentagon has missed FOIA deadlines and withheld records as he seeks the deal’s terms on transgender members.
- On Thursday, James Dale filed a federal lawsuit in New York City seeking the Pentagon's agreement with Scouting America, alleging the Department has withheld the document regarding potential transgender member policy changes.
- In February, the Pentagon struck a deal with Scouting America that Defense Secretary Pete Hegseth said would refocus the organization away from 'woke' policies. Scouting America later claimed the agreement did not change existing policies welcoming transgender youth.
- Hegseth had pledged to "vigorously review" changes, threatening to cease military support if Scouting America failed to comply in six months, which would be in late August. He emphasized members must use their biological sex at birth, not gender identity.
- Dale's complaint seeks to enforce the public's right to know before the Department's August deadline expires. The lawsuit argues the government obtained by contract what the Supreme Court once held it could not command by law.
- The Department has missed every deadline to produce the record and declined to comment on ongoing litigation. Scouting America President and CEO Roger Krone stated that "we have transgender people in our program and we'll have transgender people in our program going forward.
