CJI Surya Kant: Will ask Greater Noida magistrate to explain notice to student over Jantar Mantar protest
The court said it will seek an explanation after a magistrate issued a Rs 5 lakh bond notice to a Gautam Buddha University student over a protest.
- On Tuesday, advocate Shailendra Mani Tripathi filed a rejoinder in the Supreme Court alleging that Delhi Police conduct during the July 20 crackdown was "contrary to constitutional guarantees but also manifestly criminal in character."
- Tripathi argued that officials deployed paramilitary forces and infiltrated peaceful student processions with "chaotic elements," while surveillance showed an "opaque infiltration of private commercial entities into sovereign policing functions."
- Flawed surveillance data undermined police claims, as the rejoinder highlighted that while police identified 2,873 individuals, 25 out of 205 major cases involved prisoners, risking harassment for 2,668 innocent students.
- The Supreme Court questioned the Greater Noida Executive Magistrate on Wednesday for issuing a notice to student Akshat Tripathi, who allegedly participated in a CJP-led protest, despite prior court orders.
- Chief Justice of India Surya Kant demanded an explanation from the magistrate, reiterating that the court had passed a "clear-cut order" preventing penal action against students and stating "inconvenience is not synonymous with violence.
