Civil rights groups sue to stop Texas immigration law
The civil rights groups say the law would let Texas police and magistrates deport people and punish re-entry despite federal immigration cases.
- On Monday, civil rights groups including the Texas Civil Rights Project and American Civil Liberties Union of Texas filed a lawsuit to block Senate Bill 4, a 2023 law empowering state police to arrest and deport people suspected of illegal border crossings.
- Plaintiffs challenge four provisions of SB 4, including criminalizing unauthorized re-entry and granting state magistrates deportation authority, arguing immigration enforcement is exclusively the federal government's constitutional domain.
- ACLU of Texas Legal Director warned the law "transforms police and judges into immigration agents," threatening residents with legal status. Kate Gibson Kumar of the Texas Civil Rights Project said "our fight against SB 4 isn't over until justice wins."
- The Fifth Circuit Court of Appeals lifted a long-standing injunction two weeks ago, ruling plaintiffs lacked standing to challenge the law. Enforcement is now scheduled to begin May 15 unless halted by another court.
- Governor Greg Abbott backed the law, enacted in response to record border crossings that state leaders argued amounted to an invasion. Texas Attorney General Ken Paxton did not immediately respond to requests for comment on the suit.
