Burke to remain in jail for refusing to obey court order
Burke can be released if he agrees to stay away from the school, but he continues to challenge the contempt finding and dismissal.
On Tuesday, Enoch Burke appeared in the High Court via video link and refused to purge his contempt, ensuring he remains jailed at Castlerea Prison for violating orders banning him from Wilson Hospital School.
Burke has spent more than 650 days in prison for violating High Court orders prohibiting his presence at Wilson Hospital School, stemming from his 2022 dismissal after refusing to address a student by a chosen name and pronoun.
Judge Brian Cregan told Burke, "You know perfectly well that you are in breach of a High Court order," noting the court has no "interest or desire" in impeding his religious beliefs but requires compliance with valid orders.
While seeking a late appeal through the CoA, Burke told the court a third Disciplinary Appeals Panel hearing his dismissal challenge has "crashed" after he objected to the presence of board of management lawyers.
Judge Cregan adjourned the matter for four weeks, observing that Burke had not appealed his suspension for "almost three years," while the teacher insisted he should not be behind a prison door.
