Brazilian data protection regulator fines TikTok’s owner nearly $30 million over safety of minors

The regulator said ByteDance processed data from at least 8 million minors without a valid legal basis and ordered deletions, notices and tighter safeguards.

  • On Tuesday, Brazil's National Data Protection Authority fined TikTok owner ByteDance 153.8 million reais for allegedly violating the country's General Data Protection Law regarding children's and teenagers' personal data.
  • According to ANPD, ByteDance processed personal data of teenagers aged 13 to 18 without a valid legal basis, failing to implement sufficient technical and organizational measures to prevent improper data collection.
  • ByteDance must delete personal data of teenagers whose legal representation is not regularized within 60 business days and faces daily fines of 137,081.49 reais for failing to comply with reporting requirements.
  • TikTok faces additional restrictions in Brazil, including time limits and suspended advertising for unregistered users, while committing to apply restrictive privacy settings to accounts for users under 16 with parental authorization required for changes.
  • This action aligns with President Luiz Inacio Lula da Silva's push for stronger online safeguards; earlier this month, ANPD ordered chat platform Discord to suspend livestreaming features, reflecting a global trend of stricter rules on minors' social media usage.
