The judge ruled that Apple, Google, and Meta can face consumer protection claims for earning over $2 billion in commissions from casino-style apps linked to addiction and harm.
- On Tuesday, U.S. District Judge Edward Davila denied Apple Inc., Google and Meta Platforms' requests to dismiss lawsuits alleging promotion of illegal casino-style gambling apps.
- Alleging addiction and financial harm, the plaintiffs say the apps offered an `authentic Vegas-style experience of slot machine gambling` and triggered depression while brokers collected 30 per cent commissions worth more than $2 billion.
- On Section 230 issues, U.S. District Judge Edward Davila rejected Apple Inc., Google, and Meta Platforms' claim to immunity, finding they did not act as `publishers` when processing payments for social casino apps.
- Davila said Apple, Google and Meta may immediately appeal his decision to the 9th U.S. Circuit Court of Appeals because of the Section 230 issues, while the complaints seek compensatory and triple damages.
- The cases are before the U.S. District Court, Northern District of California, San Jose as In re Apple Inc App Store Simulated Casino-Style Games Litigation, with some claims dismissed but consumer-protection counts intact except in California.
