Alleged Cybercrime: Prosecution Faults Sowore's Demand For DSS Chief To Testify
Prosecutors said another DSS official can testify because Director General Tosin Ajayi acted only in an official capacity.
- Prosecution counsel Akinlolu Kehinde argued before the Federal High Court on Friday that Omoyele Sowore's legal team is wrong to insist that DSS Director General Tosin Ajayi must personally appear to testify in the cyberbullying trial.
- Sowore, the African Action Congress presidential candidate, faces cyberbullying charges stemming from August 2025 social media posts in which he called President Bola Tinubu a "criminal" and accused him of misrepresenting corruption levels.
- Kehinde cited the 2002 Supreme Court ruling in Ishaq v. Soniyi establishing that naming a public official in a subpoena does not mandate personal appearance, contradicting defense counsel Adeyinka Olumide-Fusika's reliance on DSS official Uwem Davies' testimony.
- Justice Mohammed Umar adjourned proceedings until October 6, 2026, to rule on whether the DSS Director General can be compelled to personally testify regarding actions taken by the Service.
- The prosecution recalled a July 28, 2026, submission by Attorney General Lateef Fagbemi, who argued the defense cannot insist on the Director General's personal appearance when another appropriate official can represent the agency.
