AfriForum Targets Mbalula, Malema in Prosecution over Bergview Rape Claims
AfriForum says the NPA will charge Mbalula with crimen injuria after his remarks about the Bergview case were found to have harmed a former principal’s dignity.
- On Monday, AfriForum announced that their lobbying of the National Prosecuting Authority had succeeded, forcing the state to prosecute ANC secretary-general Fikile Mbalula for crimen injuria alongside EFF leader Julius Malema for allegedly making false child rape accusations.
- The charges stem from public statements where Mbalula branded former Bergview College principal Jaco Pieterse a child rapist. AfriForum argues these claims were baseless and violated Pieterse's right to dignity without supporting evidence.
- In May last year, the National Prosecuting Authority confirmed it would not prosecute anyone for the alleged rape, stating medical examinations showed no evidence of sexual assault. Gerrie Nel, head of the Private Prosecution Unit, subsequently challenged that decision as irrational.
- Calling the decision "absolutely wonderful," Attorney Emile Myburgh argued that crimen injuria is necessary to address the tremendous harm caused by such serious false accusations. He emphasized that politicians should face the full force of the law for such conduct.
- Separately, the Private Prosecution Unit continues pressuring the National Prosecuting Authority regarding Mbalula's family holiday in Dubai. National Director of Public Prosecutions Andy Mothibi has instructed the Hawks to finalize outstanding aspects of that investigation.
